Process

How collection in Spain proceeds

Amicable phase

Spanish formal demand; interest and the €40 fee are stated, a payment plan negotiated. Turkish reporting from Incasso Mentor.

Monitorio

The first filing can be made without a lawyer (court of first instance). The debtor pays, objects or stays silent within 20 days; silence produces an enforceable title.

Court action if objected

Juicio verbal up to €15,000, juicio ordinario above; 6–12 months. From here an abogado and a procurador are as a rule mandatory.

Enforcement and insolvency

There is no independent bailiff: the court, through its clerk (LAJ), attaches bank accounts and wages, auctions assets (Portal de Subastas) and searches for assets. Insolvency: concurso de acreedores before the commercial court.

Three points that matter for a Turkish exporter

Two representatives: abogado and procurador

Contested proceedings require both professions; this is specific to Spain and affects cost. Incasso Mentor obtains a fixed quote before handing over.

Five years to enforce

After a final judgment, enforcement must start within 5 years; otherwise the right lapses.

EU procedures closed

The European order for payment and small claims are only for EU-established claimants; a Turkish exporter uses the national monitorio. No Spanish establishment is required.

How long does collection in Spain take?

Unopposed monitorio 2–4 months; if opposed, 6–12 months of proceedings, then court-run enforcement.

Do I need a lawyer?

Not for the first monitorio filing; for objection, trial and enforcement you need an abogado and a procurador.

Who pays the costs?

The losing party is ordered to pay costs (condena en costas). Interest and the €40 fee are charged to the debtor; court fees depend on the case.
