Process

How collection in Ireland proceeds

Amicable phase

Demand in English; interest and the flat fee are claimed. No licence is required for agencies in Ireland; contact hours and a harassment ban are set by law.

Claim and default judgment

A solicitor prepares and files the claim; without a defence, default judgment without a full hearing. Fees District Court €25–80, Circuit Court €90–130. Indication: 3–6 months undisputed.

If defended

Hearing at the competent court; timeline depends on the case. Small Claims (€2,000) is closed to companies.

Enforcement and insolvency

Sheriff or County Registrar seizure of movables (€19), judgment mortgage (€20), garnishee (bank/third party), instalment order. Above €10,000: statutory demand 21 days, then winding-up (Companies Act 2014 s.570); examinership 70 days' protection.

Ireland has no national order-for-payment procedure; every commercial claim is filed by a solicitor. We hand over in English and obtain a fixed quote.

The statutory demand is a strong lever

For undisputed debts above €10,000: 21-day statutory demand, then the threat of a winding-up petition; Irish companies react quickly.

EU member, but EU procedures closed to Turkish companies

The European order for payment and small claims are for EU-established claimants; a Turkish exporter uses the national route. The judgment is enforced in the EU under Brussels I-bis and in Turkey through tenfiz.

How long does collection in Ireland take?

Indication 3–6 months to a default judgment in an undisputed file; a defended case longer. A statutory demand can produce results within 21 days.

Do I need a solicitor?

No legal requirement is named, but in practice every commercial claim is filed by a solicitor.

Who pays the costs?

Court fees are low (€25–130); costs are charged to the debtor when you win. Interest and the €40/70/100 flat fee are for the debtor.
