How collection in Belgium proceeds
Amicable phase
Demand in Dutch or French (by region). Interest and the fixed collection compensation run automatically; a payment plan is negotiated. Agencies must be registered with FPS Economy.
Small claims
Up to €1,860, undisputed: summary order-for-payment procedure, 15-day demand, petition signed by a lawyer, decision by the justice of the peace within 15 days; fee €50.
Court action
For higher amounts a summons through a lawyer before the enterprise court. Export claims almost always follow this route.
Enforcement and insolvency
Only the bailiff (gerechtsdeurwaarder): seizure of movable and real property, wage and bank attachment (protected limits), precautionary attachment. Insolvency under Book XX of the Economic Law Code; restructuring via PRJ is possible.
