Process

How collection in Finland proceeds

Amicable phase

Finnish demand with at least 10 days to pay; the Perintälaki caps costs chargeable to the debtor (€210 in total for claims above €1,000). No contact on Sundays, public holidays or between 20:00 and 07:00.

Summary procedure

Written application to the käräjäoikeus (riidaton velkomusasia); without a defence, default judgment in 2–3 weeks. No amount limit.

Court action if objected

Transfer to ordinary proceedings: fee €310 (transfer) or €610 (contested from the start); a year or more; a lawyer is needed in practice. Appeal to the hovioikeus does not automatically stop enforcement.

Enforcement and insolvency

Ulosottolaitos: wage attachment with protected minimum, bank, movable and real property; table fee €2.50–210, distribution 1.45%. Bankruptcy (Konkurssilaki): creditors may apply, trustee pesänhoitaja; restructuring yrityssaneeraus.

Collection costs chargeable to the debtor are capped; whether a separate €40 B2B flat fee applies we confirm with our partner.

EU procedures closed

The European order for payment and small claims (up to €5,000, Helsinki) are only for EU-established claimants. A Turkish exporter uses the national summary procedure; the judgment is enforced in the EU under Brussels I-bis and in Turkey through tenfiz.
